Immigration Lawyer or Immigration Consultant: What’s the Difference?
Canada regulates who may be paid to represent you. Under section 91 of the Immigration and Refugee Protection Act, only a lawyer or notary in good standing with a law society, or a member in good standing of the College of Immigration and Citizenship Consultants, can charge a fee to advise or represent you on an immigration matter. Anyone else offering to do so for money is not authorised.
What Both Can Do
Licensed consultants and lawyers can both assess which program fits your situation, prepare and submit applications to IRCC, correspond with IRCC on your behalf, respond to requests for additional information, and represent you at Immigration and Refugee Board hearings, including sponsorship appeals. What Only a Lawyer Can Do
Lawyers can advise where an immigration matter runs into another area of law, which happens more often than people expect: a sponsorship that breaks down becomes a family law matter, a criminal charge affects admissibility, a business immigration application raises corporate questions. Communications with your lawyer are also protected by solicitor-client privilege, which does not apply in the same way to communications with a consultant. And if a refusal ultimately has to be challenged in Federal Court, only a lawyer can act there — a consultant cannot appear.

How long do immigration applications typically take?
It depends on the program. IRCC publishes current processing times for every application type and updates them regularly — you can check the estimate for your specific application on the IRCC processing times tool. What most affects your timeline is whether your documents are complete when you file, whether biometrics or a medical exam are required, and whether IRCC requests additional information. Incomplete applications are the most common cause of delay.
What documents do I need to start?
Common starting documents include passports, immigration records, refusal letters if applicable, application forms, identity documents, relationship or employment evidence, and any correspondence from immigration authorities.
How long does spousal sponsorship take in Canada?
Spousal sponsorship runs in two stages: IRCC assesses whether the sponsor is eligible, then assesses the permanent residence application itself. Processing times differ between inland and outland applications and change regularly, so check the current estimate on the IRCC processing times tool rather than relying on figures quoted elsewhere. Relationship evidence is what most often decides how smoothly an application moves — thin or inconsistent documentation is the usual reason a file is delayed or refused.
What is the super visa and who qualifies?
The super visa lets parents and grandparents of Canadian citizens, permanent residents, or registered Indians visit for up to five years at a time, on a visa valid for up to ten years with multiple entries. It is not permanent residence and it does not lead to it directly. Applicants need a letter of invitation from their child or grandchild, proof that the inviting family member meets the required income level, private medical insurance, and a medical exam. Dependants cannot be included in a super visa application.
What is the difference between permanent residence and citizenship?
Permanent residence allows a person to live in Canada with specific rights and obligations. Citizenship is a separate status that may be available after eligibility requirements are met, including residency and other application criteria.
What should I do if my immigration claim or application is refused?
Don’t wait. Review the refusal letter carefully and get legal advice as soon as possible. Appeal or review deadlines can be short, and the available options depend on the type of refusal and the reasons given.
My application was refused. How long do I have to appeal?
It depends on the decision. Sponsorship refusals are generally appealed to the Immigration Appeal Division within 30 days. An application for leave and judicial review in the Federal Court must generally be filed within 15 days if the decision was made in Canada, or 60 days if it was made outside Canada. Your refusal letter states which options apply to you. These deadlines are short and missing one usually ends the matter, so get advice immediately.
Can you help if I applied on my own and made a mistake?
Yes. We regularly take over applications that were filed without a representative. Common issues include missing supporting documents, inconsistencies between forms, the wrong program selected, or a response to a request for additional information that was late or incomplete. What can be fixed depends on where the application is in the process, so bring everything you have submitted so far to the consultation.
